Curv Group US Reseller Policy

US RESELLER POLICY

Last Update: 01/01/2019

To qualify and remain a Curv Group Authorized Reseller, your business must adhere to this Curv Group Authorized Reseller Policy at all times.

1. Maintain Current Business Information & Disclose All Locations That Carry KeySmart and Statik Products

Maintain accurate and up-to-date company information and disclose all retail locations that carry KeySmart and Statik products throughout the term of your reseller relationship with Curv Group.

Qualifying retail locations can only be one of the following: your physical brick & mortar store(s), your commerce-enabled website(s), or temporary storefronts (events, trade shows, pop up stores, etc.).

Brick & Mortar stores can be featured on the retail store locator found on our consumer website here.

2. Report Sell-Thru For Physical Retail Location(s) and E-Commerce Sites

Reseller must provide sell-thru information by SKU and approved retail location upon request. Curv Group reserves the right to perform an audit of financial statements pertaining to KeySmart and Statik sales or the business operations (conduct) to ensure compliance with this policy.

3. Curv Group's Trademarks & Brand Policy

Reseller must comply with Curv Group Trademark & Brand Policy and represent yourself as a Curv Group Authorized Reseller in all online advertising & sales collateral.

Setting up businesses, registering domain names, or social media usernames that contain any of Curv Group's trademarks is strictly prohibited unless otherwise agreed upon.

4. Curv Group's Minimum Advertised Price (MAP) Policy

Reseller must understand their obligations under Curv Group's MAP Policy and abide by them.

5. Sell To US Retail Consumers Only

Reseller may not sell in bulk to B2B accounts, wholesalers, or freight forwarders/drop shippers for other retailers.  Resellers may only sell to your end consumers.

Sales to customers outside the US are only authorized in the case that Reseller’s e-commerce website allows for international shipping.  In all other cases, Reseller may not sell to customers outside the US unless approved as an International Curv Group Dealer/Distributor, for which there is a separate application process.

6. Customer Confusion

Reseller will not advertise, market, display, or demonstrate non-Curv Group products together with Curv Group products in a manner that would create the impression that the non-Curv Group products are made by, endorsed by, or associated with Curv Group.

7. Sell On Approved Retail Website(s) Only

Reseller must only take orders via publicly accessible e-commerce enabled web pages hosted on approved websites owned and operated by your company.

Selling on 3rd party sites (eBay, Amazon, Alibaba, etc.), drop-ship accounts (Buy.com, Newegg.com, Overstock.com, etc.), classified sites (Craigslist.com, Facebook Marketplace, etc.) is strictly prohibited.

8. Obey The Law, Abide By Policy Rules & Serve Customer Needs

Reseller must ensure industry-standard e-commerce security and fraud protection measures are in place, authorized territory shipping restrictions, and customer fraud resolution procedures.

All resellers must provide Certificate of Resale in order for their state tax to be waived. In the event a Reseller cannot provide documentation, we will charge your state’s sales tax on each invoice.
